What do you think of River Hills being sued for closing portions of Green Tree Road?

Dec. 5, 2009

The city of Glendale and the Nicolet School District have filed a lawsuit against River Hills in an effort to block the village from going forward with its plan to close portions of Green Tree Road.

The legal action stems from a Nov. 19 decision by the River Hills Village Board to close the eastbound lane of Green Tree Road near Interstate 43 on a six-month pilot basis. Emergency vehicles, school buses and utility trucks would be permitted to use the eastbound lane, under the proposal. The issue came to the forefront last April when a driver with a medical problem lost control of his car and struck and killed a pedestrian walking along the road.

Supporters say this will make the road safer for residents. Opponents say the action is illegal and will make conditions more dangerous for motorists, especially students traveling to Nicolet High School.

Is this the right call? Let us know what you think in our forum.

Residents don't want it closed, they want it closed to everyone but them. Fine, pool your resources and work up an offer to buy it. In the meantime it's a public road that provides public access. The rest are not here to provide you with private drieveway.

We live right around the corner from Green Tree Rd. and utilize it as our primary means of transporting our sons to and from school not to mention shopping for food and medicine. We understand first hand why our neighbors need to have a safer road for their families and friends as our eldest two sons were first on the scene earlier this year when the horrific accident that preceded this request by residents was made. However, closing it is not going to solve this problem and will hurt thousands of residents ability to get to schools, visit fellow residents in that area, in addition to Police & Medical response as Ms. Buckley's article has already pointed out. Creating and enforcing a limited use (e.g. No Trucks and installation of a round about at River Rd. and Green Tree Rd.) would be far more effective -- particularly with the bridges over I43 at Good Hope and Green Tree will be torn down and rebuilt over the next couple of years.

I am so opposed to the closure of Green Tree Rd. My home is adjacent to Jean Nicolet Drive and the traffic by my house will double if Green Tee is closed.

The whole thing is ridiculous. And the horrible accident mentioned involved neighbors. It is unfortunate that they keep referring to it.

Frank and Maureen are right - those "complaining" neighbors want Green Tree turned into a publicly-funded private drive where students, minorities, Kletzch Park users, Glendale residents and other "strangers" are made to understand they are not welcome. Never mind the gross inconveniences this creates for non-River Hillbillies on either side. Roundabouts, "no trucks" signage and other controls can address their STATED concerns, but won't be good enough, because the won't address their unstated racism and assumed privilege.

This would be funny if it wasn't so ridiculous. How selfish can people get? This road is no different than any other road. A poor reident died in an accident, but that was health related and these clowns are taking advantage of that incident to promote their selfish wants. How about closing lake drive because of speeders, drunks, litter, etc.. Lets not spend any more time or money over this stupid topic.

I think that closing this road is crazy. I understand there was a fatal accident there this summer, however, the accident was not caused by speeding, I believe the driver of the car that was at fault was having a medical emergency. Closing of this street would cut off alot of folks from getting to PW Rd in a timely manner. And much more importantly is the issues it could cause regarding safety and safety vehicles being able to access these areas. Bad idea coming from a few people. If you want to live on a private road, go buy a piece of property with a private road.

To correct you and all you WHACKJOBS...I have followed this from day one. You all seem to think that your conveience is more important than their safty. I suggest you go down to the road between 2and6 and see the amounts of traffic. I'm sure if it was your road you would care to.

I'm not sure why you would call people whackjobs, Indo, lets be adults and have an intelligent discussion, that is what adults do to when they have conversations with differing points of view. A very unfortunate fact, people are killed on town roads, city streets, county highways and expressways everyday. Are you going to close all roads that have had fatal accidents? If you do not like the neighborhood you live in, or the things such as traffic that go along with living there, it is your right to move somewhere else. No one is obligated to live on Green Tree Road or any other road. It is a public road, and does not belong to those that live on it. Closing it will cause further safety issues, would that be better?

I don't understand why the River Hills Board made such a bad decision. I walk on both Green Tree Road and River Road quite often and can tell you that River road is far more dangerous. Cars go faster and there are no sidewalks, as there are on Green Tree Road. Is this setting a precedent for others to petition to create their own private street? Also, I assume that the people who petitioned to close Green Tree will be paying the legal fees to defend this decision.

Indo: "I'm sure if it was your road you would care to." In my humble opinion, your logic is flawed. (1) The thing is, it is my road, and it's yours and anyone else's, for that matter. Ownership of a public roadway is not conveyed simply because one's home is situated on it. (2) There is plenty of traffic on I-43 between the hours of 7 and 8:30. Should that road be closed, too? Closing the road to those who do not reside there only moves the problems being described elsewhere. It does not solve the problem. Instead of operating from a point of emotion (i.e. WHACKJOBS, when someone disagrees with your opinion), let's work together to come to resolve the issue. Merry Christmas.

We are sad about the doctor killed on Green Tree in River Hills but we do NOT think a major artery should be closed. One resident who lives on that stretch of road claimed to me that the residents "owned" the road. Huh? We are VERY opposed to the closing of Green Tree in River Hills for all the reasons everyone else in this forum has mentioned. The fact that the River Hills Green Tree residents keep referring to a tragic accident that involved a driver having a medical emergency and a pedestrian who happened to be in the wrong place at the wrong time has smacks of opportunism for their own gain. Plus, the houses on the south side are set way back and the houses on the north side have a sidewalk. We are also concerned about easy access to Nicolet from BOTH sides of the district and the corner of Good Hope Road and Port Washington becoming dangerous. Perhaps we should ditch our cars and start to bike or walk? We live on Green Tree in Fox Point and worry about cars and the kids in our neighborhood too. But to suggest that we close our street would be absurd... and elitist.

The residents should not be allowed to close the road. Putting speed bumps on the road would help. The accident was not from speed but a medical condition. It could have happend anywhere.

That road is necessary for many people going to that area of Glendale. People that live on that stretch of Green Tree Road purchased their homes knowing that the street was a main thoroughfare. The accident was very unfortunate, but this could have happened on any street. Should every neighborhood have the right to stop traffic flow in order to make the road safer? Should MIlwaukee River Parkway get closed so that pedestrians walking there are safer? How about Bender Road, another area pedestrians frequent. What is really the motive behind this action?

It's very unfortunate to hear about the Village's decision regarding the half-closure. I run and drive along this stretch of Green Tree on a regular basis, often during the peak travel times. There are so many better solutions here than to close the roadway. If the issue really is speed (like I said I run along here regularly and haven't seen excessive speed more than on any other street), there are plenty of traffic calming solutions or enforcement options to consider first. I am hoping the City of Glendale, Nicolet, and others can put enough pressure on the Village to end this nonsense. This is an extreme case of NIMBY-ism (Not In My Back Yard) - there's just no other way to say it. This has nothing to do with the tragic accident occurred that was a result of a medical condition, it's unfortunate that this group of residents are trying to tie this in. I live on Milw River Pkwy, further south of the area. There's an increase in traffic volumes during the morning and evening rush, but I still consider it a low volume collector street (similar average daily traffic volumes to Green Tree Rd - http://www.dot.wisconsin.gov/travel/counts/docs/milwaukee/glendale2007.pdf). There are occasional speeders, garbage in my front yard, etc - perhaps we should close it too?? Ridiculous!

Sure- let's close off Green Tree. Then, lets close off some of the other streets in Glendale, that River Hills residents use to access their homes. Maybe this will make them stop, and realize what they are doing. This is all likely an issue created by some wealthy individuals, that have absolutely too much time on their hands. I can't wait to see who is going to be bold enough to put their names on this one....

This attempt to restrict, and probably ultimately close off that section of Green Tree Rd is quite possibly the most ridiculous example of isolated, entitled suburban mindset I have ever seen. From comments quoted in local news coverage to the tune of "we blame the bayshore expansion, and the new grocery store up the road", having been born and raised on the north shore, as thinly disguised racism. My suspicion is that it is less about how fast people are traveling on "their" tax-payer funded and maintained road, and more about who is driving on it. I live nearby and drive this stretch of road several times a week --- (actually more often, now that I've become aware of this issue :) I drive it at many times of day, and have yet to ever see speeding, or even anything I would ever describe as heavy traffic. As far as safety issues go, I find there are much more serious safety risks caused by the many private contractor and lawn service trucks that are almost always obstructing one way of traffic. They are often parked just below the crest of the hill, so that motorists are forced to have to pass them with frighteningly little visibility of oncoming traffic. I also note that these trucks are parked on the street in front of houses that have driveways at least 50 yards long. I have no sympathy for these petitioners. If traffic in front of my home was one of the biggest problems in my life, I would consider myself blessed. This case will be shut down, and shut down quickly. Also, I am very proud of the amount of River Hills residents who have opposed this action -- whoever you are, you deserve some serious credit for not letting this go on without calling it out --- thanks

One way closure of Green Tree is being proposed by way of a loophole in state law that only addresses complete road closure, but fails to address partial one directional closure. I am not an attorney. But noone else has discussed this in any of these forums. I would like to believe that changing a roadway from a 2 way thoroughfare to a one way street is predicated on the conclusion that such a change in traffic flow is necessary based on something other than a select and local group of individuals who simply don't like the status quo. The roadway is not typically affected by parked cars with doors opening to endanger pedestrians or bicyclists. Traffic flow on neighboring roads would in fact be impaired and even overwhelmed at times by the reconfiguring of Green Tree traffic for the satisfaction of a few. Until a few years ago, there were many more destinations east of the roadway in question that many of us drove that very strip of GTR to get to. Don't you think the old Green Tree School that occupied the spot where the Radisson Hotel now sits generated more daily local traffic up and down GTR than the hotel does? How many of us have a daily desire to visit the Radisson? Even the old Chinese restaraunt is gone. I guarantee the old regulars who patronized the food and bar are not at Samurai at Glendale Marketplace! Have we all forgotten about the 500 bed nursing home that collected round the clock traffic form family visitors, employees, vendors and deliveries? The residents of GTR need to stop acting like the folks of 53209 and 53217 just discovered Green Tree Road.

Please post copies of the summons and complaint and responsive pleadings on the communitynow.com website so residents can be as informed as possble on factual and legal issues. This issue is of great concern to residents as indicated by your forum, and the procedural issues are of as much concern as the alteration of the traffic patterns. Will other residents be permitted to cram through this type of major urban planning on short notice? For example, Spruce Road in River Hills has had three robberies in the past several weeks, according to a police officer who was kind enough to come to our door. Certainly, that is a compelling, statistically supported reason to close off Spruce to public traffic. Perhaps people along this main artery of River Hills should follow the precedent set by the villiage board and gather a couple dozen homeowners (e.g., about 27 of them- many of them spouses to be consistent with the Green Tree road decision). All it would take, under the precedent set, is a few dozen homeowners to make Spruce one-way street and harder to accesss.

It's me again, everyones favorite nutball. Just kidding. It's very clear many of you bloggers are misinformed. But I have been to the village hall talked to the village manager and I highly suggest you become more informed on the subject because I was like you I thought a full closure was HORRIBLE.... Making it a one way closed to traffic going east toward the lake is a good thing in some ways. I live on River Road and don't mind going up Good Hope Road and south on Port Washington so people can be safe. coming from the Kletch park stop sign to the shopping center going the speed limit is an extra 5 minutes. I'll tell you that ever since that accident I try to always go the speed limit ,because remember a limit is a limit. I'm willing to respect my neighbor's speed limits for their and everone elses public saftey. I encourage everyone to go the speed limit and to be a little unselfish, because that road is a nightmare.
